ORDINANCE NUMBER 2009-1
ORDINANCE PROHIBITING THE PARKING OF VEHICLES AT THE INTERSECTION
OF NORTH CHATHAM ROAD (PA ROUTE 841) AND SPRINGDELL ROAD IN
WEST MARLBOROUGH TOWNSHIP, AND ESTABLISHING ENFORCEMENT
PROVISIONS AND PENALTIES FOR VIOLATIONS OF THE ORDINANCE.
WHEREAS, the West Marlborough Township Board of supervisors have determined that
the parking of vehicles at or near the intersection of North Chatham Road (Pa. Route 841)
and Springdell Road, has created an unsafe condition for motorists, pedestrians
and property owners;
WHEREAS, the Supervisors have determined it is necessary to install "No Parking" signs at
this intersection in order to protect the public safety, health and welfare;
WHEREAS, the Second Class Township Code specifically authorizes the Supervisors to
regulate parking within the Township by Ordinance and to impose penalties
for violating such regulations, 53 P.S. 67328;
WHEREAS, pursuant to Pennsylvania Department of Transportation's Publication 212,
"Official Traffic Control Devices," it has been determined that the following
conditions, as set forth in 212.114 (a) of Publication 212, warrant restricting parking
at this intersection:
(1) The distance between the center of the center line pavement markings and the
edge of the roadway is less than 18 feet.
(2) The street width is such that, if vehicles are parked along both edges of the roadway,
two vehicles cannot move abreast of one another in the same or opposite direction
without anyone yielding to allow the other vehicle to pass.
(3) The width of the shoulder is not sufficient to allow a vehicle or its load to park
completely off the roadway.
NOW THEREFORE, the Board of Supervisors of West Marlborough Township, Chester
County, Pennsylvania, a Municipal Corporation of Pennsylvania, organized and existing
pursuant to the Second Class Township Code of Pennsylvania, Public Law 350, Act 60 of 1995,
53 P.S. 65101, et seq., does hereby enact and ordain as follows:
(1) Parking Prohibited. At no time shall any vehicles park, idle or otherwise stop (except for emergency
purposes) on or beside the cartway, shoulder or right-of-way of the following sections
of the roadways:
(a) on both sides of Springdell Road starting from the intersection of North Chatham Road
(Pa Route 841) and Springdell Road and going North for four-hundred (400) yards;
(b) on both sides of North Chatham Road (Pa Route 841) from the intersection of
North Chatham Road (Pa Route 841) and Springdell Road, going West for four-hundred (400) yards;
(c) on both sides of North Chatham Road (Pa Route 841) from the intersection of North Chatham Road
(Pa Route 841) and Springdell Road, going East for four-hundred (400) yards;
(2) No Parking Signs to be Installed. The Township's Roadmaster, or any duly authorized
employee or agent of the Township, shall place "No Parking" signs along the sections of roadway identified
above at a location to adequately advise the public that parking is prohibited in these areas.
(3) Penalties and Enforcement. Any person who violates or permits the violation of this Ordinance
or fails to comply with any of the requirements imposed by this Ordinance shall, in addition
to any other remedy available at law or in equity, be subject to a criminal fine in the amount of $25.00
for the first violation, $50.00 for the second violation and $75.00 for the third and any
subsequent violation. Each twenty-four hour period that a violation continues
shall be deemed a separate offense. As autorized by the Second Class Township Code, 53 P.S. 66601 (C.1)(2), enforcement of this Ordinance shall be by action brought before a district justice in the
same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of
Criminal Procedure. The municipal solicitor may assume charge of the prosecution
without the consent or authorization of the District Attorney of Chester County.
(4) Enforcement officers and agents. The Board of Supervisors delegates the initial
determination of an ordinance violation and the service of such notice of violation to any officer
of the East Marlborough Township Police Department and to West
Marlborough Township's Roadmaster.
(5) This Ordinance shall be effective on the 5th day from the date of enactment.
